Consumer Credit Agreements include Hire Purchase Agreements, credit sales, personal loans, credit cards, overdrafts and mortgages not exceeding £25,000 provided by finance companies.
What to consider - Read all the terms of the agreement to check your understanding of the arrangement.
- Certain agreements are "cancellable" within a cooling off period.
- Don’t sign unless you are sure.
Once you have signed and you wish to get out of the agreement consider:
- Are you still within any cancellation period?
- Have the goods proved to be faulty?
- Has there been any misrepresentation about the goods?.
- Is it possible to make early repayment?
If you cannot afford the repayments consider
- Re-negotiation of the terms.
- Whether cheaper finance is available.
The court has power to set aside obligations imposed under "extortionate" credit agreements.
