There are statutory controls over the positioning of advertisements. If express consent is required the application must be made to the local authority
Consider these examples: - Advertisements displayed on a vehicle will probably not need consent as long as the vehicle is not principally a "display" vehicle.
- Advertisements on articles for sale or containers may or may not require consent, depending on the size of the advert and whether it is illuminated.
- Illuminated advertisements require certain detailed conditions to be fulfilled in order for deemed consent to be granted.
- Flag advertisements also require certain detailed conditions to be fulfilled.
- Advertisements on forecourts of business premises require certain detailed conditions to be fulfilled.
- Advertisements on hoardings also have specific provisions relating to them.
- Balloon advertising may require consent in certain circumstances eg if the site is used for more than 10 days per year.
