
Did you know your Will could be challenged after you die?

The recent High Court decision in the Anna Rea case highlights the importance of getting good legal advice when you are thinking about preparing a Will.
Anna Rea died in 2016 leaving her entire 1-million-pound estate to her daughter, cutting her three sons completely out of her Will.
Her sons brought a claim against her estate arguing that they should have also inherited under their mother's Will - current legislation allows these types of claims to be made.
Anna Rea had created a Will in 1986 which left her estate equally between her four children but she made a new Will eight months before she died cutting her sons out.
The sons' claim against their mother's estate failed.
Anna Rea’s solicitor had not only drafted her a sound Will but had included a declaration which explained why she had not left anything to her sons.
This ensured they were prepared for a claim, the service provided by the solicitor was sound and their advice helped to ensure that her wishes were carried out and her Will stood-up to challenge.
