
Residential Tenant Evictions - Update

In the previous January blog we detailed the new Government regulations surrounding Tenant evictions from residential premises. The new regulations will prevent an attendance at a dwelling house in England for the purpose of a bailiff executing a writ or warrant of possession except in certain specified circumstances. These circumstances include:-
- Against trespassers to which the Civil Procedure Rules apply (persons unknown)
- wholly or partly on the grounds of:-
- Antisocial behaviour (Ground 7A)
- Nuisance (Ground 14)
- Domestic abuse (Ground 14A)
- False statement (Ground 17)
- Where a property is unoccupied following the death of a tenant
As the Government has laid out more plans, we now bring you the following updates:
- The restrictions on residential evictions in England will continue until at least 31 May 2021. Exemptions will still apply for the most serious cases, but it is not clear whether these will be the same as under the current regulations.
- The increased notice periods to be given to residential tenants will continue to apply until at least 31 May 2021.
