Breast cancer negligence claims tend to be either as a result of misdiagnosis, a delay in diagnosing or surgical negligence.

The types of breast cancer negligence could include:
- Failure by breast radiologists to correctly interpret and report on mammograms, ultrasound scans and other scans to determine the existence of malignancies or potential breast cancer
- Failure by pathologists to correctly interpret and report on biopsies including needle aspiration and tissue, resulting in a failure to take appropriate action
- Not obtaining sufficient clear margins when removing the tumour via surgery
- Inappropriate adjunctive therapy for the type of tumour
- Not being given adequate information to decide which treatment option is best and therefore not obtaining informed consent to surgery
- Inappropriate, unnecessary or excessive surgical treatment including lymph node surgery or mastectomy
