Single Payment Scheme entitlements transfer deadline
Burnetts' agricultural law solicitor Joanne McKenzie discusses Single Payment Scheme (SPS) entitlements.
The Rural Payments Agency (RPA) changed the deadline for farmers to transfer single farm payment entitlements this year and the cut-off date for transferring entitlements of midnight on Tuesday 21st October 2014 has now passed. The RPA had to have received the RLE1 form six weeks before the transfer was due to take place so for the deadline of midnight on 21st October 2014 the ‘effective date of transfer’ must have been on or before 3rd December 2014.
SPS entitlements will become Basic Payment Scheme (BPS) entitlements on 1st January 2015. From early 2015 farmers will be able to transfer these BPS entitlements. Go to www.gov.uk/cap-reform to find out more. But what about the transfer entitlements under the new scheme?
From 22nd October to early 2015, the RPA will be converting current SPS entitlements into BPS entitlements, so it will not be possible to transfer entitlements during this period.
If you are buying or selling entitlements (with or without land) then check out the RPA’s guidance on their website https://www.gov.uk/transfer-sps-entitlements or for further information, contact Joanne McKenzie on 01228 552222.
