Removing Executors and Trustees

 

Executors and Trustees are under strict duties to administer the estate or trust. These duties broadly extend to acting in the beneficiaries’ best interest and accounting to them for the steps they have undertaken. They also must ensure they are not acting where they have a conflict of interests.

In the event an executor or trustees acting in breach of duties, it is possible to seek their removal and replacement by making an application to the Court.

Alongside these claims, it common to also pursue a claim against the executors/trustees for any losses that have been incurred by the estate as result of the executor’s conduct.
